1. Agreement to Terms

By accessing and using FactCheckTool ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

IMPORTANT: These terms contain binding arbitration and class action waiver provisions that affect your legal rights. Please read them carefully.

2. Description of Service

FactCheckTool provides AI-powered fact-checking and credibility analysis for online content including articles, videos, and social media posts. The Service analyzes content and provides credibility scores based on available information and sources.

We offer one free fact-check per user. Additional fact-checks require a paid subscription or purchase of credits.

This is a BETA service. Features, functionality, and pricing may change without notice during the beta period.

3. User-Submitted Content and No Endorsement

FactCheckTool is a neutral platform. Users submit URLs and content for analysis at their own discretion. We do not:

  • Control, verify, or pre-approve content submitted by users
  • Endorse, support, or oppose any content, website, or claim analyzed
  • Take responsibility for the accuracy, legality, or appropriateness of user-submitted URLs
  • Guarantee that our analysis reflects our own views or opinions

You are solely responsible for any content you submit for analysis. You warrant that:

  • You have the right to submit the content for analysis
  • Your use of the Service does not violate any third-party rights
  • You will not submit illegal, defamatory, or infringing content
  • You accept full liability for your submissions and their consequences

4. AI Analysis Limitations and No Warranty of Accuracy

Our Service uses artificial intelligence and automated analysis. WE DO NOT GUARANTEE 100% ACCURACY of our fact-checking results.

Important Limitations:

  • AI can make mistakes: Our analysis may contain errors, inaccuracies, or outdated information
  • Sources can be unreliable: Cited sources may be outdated, inaccessible, or incorrect
  • Scores are estimates: Credibility scores are algorithmic estimates, not definitive truth determinations
  • Context matters: Automated analysis may miss nuance, context, or recent developments
  • Not legal advice: Our analysis does not constitute legal, financial, medical, or professional advice
  • Not investigative journalism: We do not conduct independent investigations or verify primary sources

You should:

  • Use our Service as ONE of multiple verification methods
  • Exercise independent critical thinking and judgment
  • Consult original sources and experts when making important decisions
  • NOT rely solely on our analysis for critical matters
  • Verify information through multiple independent sources

5. User Accounts and Security

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your account and device
  • All activities that occur under your account or password
  • Notifying us immediately of any unauthorized use
  • Ensuring you log out at the end of each session

We reserve the right to disable any account at any time for any reason, including violation of these Terms.

6. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable local, national, or international laws or regulations
  • Infringe upon intellectual property rights of others
  • Transmit harmful, threatening, abusive, harassing, defamatory, or obscene content
  • Submit content you do not have the right to submit
  • Attempt to bypass, disable, or interfere with security features
  • Use automated systems (bots, scrapers, crawlers) without prior written permission
  • Resell, redistribute, or commercialize our Service without authorization
  • Submit false, misleading, or deceptive information
  • Harass, defame, or harm individuals or businesses through malicious submissions
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service or servers
  • Collect user data without consent

Prohibited Content: You may not submit content that contains or promotes:

  • Child sexual abuse material (CSAM) or exploitation
  • Terrorism, violence, or illegal activities
  • Hate speech, discrimination, or harassment
  • Malware, viruses, or malicious code
  • Private or confidential information without authorization

7. Pricing, Payment, and Refunds

Certain features of the Service require payment. You agree to provide current, complete, and accurate purchase and account information for all purchases.

Pricing and Billing:

  • All fees are quoted in the currency specified at checkout
  • Fees are exclusive of applicable taxes unless stated otherwise
  • Subscription fees are billed in advance on a recurring basis (monthly/annually)
  • You authorize us to charge your payment method for all fees
  • We reserve the right to modify pricing with 30 days' advance notice
  • Price changes do not affect existing active subscriptions until renewal

Refund Policy:

  • No refunds will be provided for subscription fees or credit purchases, except as required by law
  • Subscription cancellations take effect at the end of the current billing period
  • No refunds or credits for partial months or unused credits
  • We reserve the right to issue refunds at our sole discretion

Free Trial: If you sign up for a free trial, we may require payment information. You will be charged when the trial ends unless you cancel before the trial period expires.

8. Content Removal and DMCA Compliance

We respect intellectual property rights. If you believe content analyzed on our platform infringes your copyright, trademark, or other rights, you may request removal.

To request content removal, email us at: contact@factchecktool.com with:

  • Your contact information (name, email, phone)
  • Description of the copyrighted work or protected content
  • URL of the analysis result you want removed
  • Statement that you are the rights holder or authorized to act on their behalf
  • Statement that your request is made in good faith

We will review requests within 5-10 business days. We reserve the right to remove any content at our sole discretion.

Counter-Notice: If you believe content was removed in error, you may submit a counter-notice following the same procedure.

9. Indemnification

You agree to defend, indemnify, and hold harmless FactCheckTool, its owners, operators, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms of Service
  • Your violation of any third-party rights
  • Content you submit for analysis
  • Your violation of any laws or regulations
  • Any claims by third parties related to your use of the Service

This indemnification obligation survives termination of your account and your use of the Service.

10. Intellectual Property Rights

The Service and its original content, features, functionality, code, design, and trademarks are owned by FactCheckTool and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

User Content: You retain ownership of content you submit for analysis. By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process, analyze, and display your submitted content
  • Generate and display analysis results
  • Improve our AI models and Service (in aggregated, anonymized form)
  • Comply with legal obligations

This license terminates when you delete the analysis or your account, except for cached or backup copies.

11. User Data and Privacy

We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided by you is accurate.

Analysis Results: Fact-check results may be publicly accessible via unique URLs. Do not submit sensitive or confidential content you wish to keep private.

12. Termination and Suspension

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Suspected fraudulent, abusive, or illegal activity
  • Extended inactivity
  • Requests by law enforcement or government authorities
  • Discontinuation or material modification of the Service
  • Technical or security issues

Upon termination:

  • Your right to use the Service ceases immediately
  • You remain liable for all amounts due up to the date of termination
  • We may delete your account and all associated data
  • No refunds will be provided for unused time or credits

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

  • Accuracy: We do not warrant that analysis results are accurate, complete, or reliable
  • Availability: We do not warrant that the Service will be uninterrupted, timely, secure, or error-free
  • Quality: We do not warrant that defects will be corrected or that the Service is free of viruses
  • Merchantability: No warranty that the Service is suitable for your purposes
  • Fitness for Purpose: No warranty that the Service meets your requirements
  • Non-Infringement: No warranty that use of the Service will not infringe third-party rights

Your use of the Service is at your sole risk. Any material or data obtained through the Service is accessed at your own discretion and risk.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACTCHECKTOOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes damages resulting from:

  • Errors, mistakes, or inaccuracies in analysis results
  • Reliance on analysis results for any purpose
  • Business decisions made based on our analysis
  • Reputational harm or financial losses
  • Unauthorized access to or use of our servers or your data
  • Interruption or cessation of the Service
  • Bugs, viruses, or malicious code transmitted through the Service
  • Content, conduct, or defamatory statements of third parties
  • Loss or corruption of data
  • Cost of substitute services

These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

15.1 Informal Resolution

Before filing a claim, you agree to contact us at contact@factchecktool.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

15.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration rather than in court, except:

  • Claims for injunctive or equitable relief
  • Claims involving intellectual property rights
  • Small claims court matters (below jurisdictional limits)

15.3 Arbitration Rules

  • Location: Arbitration will be conducted in Geneva, Switzerland
  • Rules: Swiss Rules of International Arbitration
  • Language: English
  • Costs: Each party bears its own costs unless the arbitrator decides otherwise
  • Decision: The arbitrator's decision is final and binding

15.4 Class Action Waiver

YOU AND FACTCHECKTOOL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

You agree to waive any right to participate in a class action, class arbitration, or representative action.

15.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to contact@factchecktool.com within 30 days of first accepting these Terms. Your opt-out notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts located in Geneva, Switzerland.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FactCheckTool regarding the Service.

17.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

17.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

17.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

18. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by:

  • Posting the new Terms on this page
  • Updating the "Last updated" date
  • Sending you an email notification (for significant changes)
  • Displaying a prominent notice on the Service

Material changes will take effect 30 days after notice is provided. Non-material changes take effect immediately upon posting.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
